A trademark typically protects names, words, slogans and symbols that identify a business or brand and distinguishes it from others. Trademarks include brand names such as "Coca-Cola" and symbols such as Nike's famous "swoosh."

Legal Zoom Review for August 2020 - Trademark Registration

I started working with LegalZoom several years ago. But most of the reason why I decided to work with them now for a couple of provisional patents, and I'm one second away from filing my non-provisional patent application, is that it’s really an apples to apples comparison. They’re drastically less expensive than going through the Yellow Pages and trying to find a patent broker or a patent attorney. Their rates are sometimes six and seven times more than the process usually takes with LegalZoom.

Over the next several years, Pegasus Technologies, Inc. used the trademark extensively in commerce.  One day, Pegasus Technologies’ right to the trademark registration was challenged by another company.  Pegasus Technologies fought the legal challenge, but ultimately the trademark registration was canceled.  Why?  Because when Michael prepared the original trademark application, he listed himself as the owner of the trademark rather than Pegasus Technologies, Inc.  Clearly, Michael was never the owner of the trademark.  He was only the CEO of Pegasus Technologies, Inc.  The true owner was always Pegasus Technologies, Inc.

“ LegalZoom is not a law firm, and the employees of LegalZoom are not acting as your attorney.  LegalZoom 8767 s legal document service is not a substitute for the advice of an attorney.”

6 Consists of the government discounted Teas Standard electronic filing fee of $775. If the stricter "TEAS Plus" system can be used for your application, LegalZoom will use this system. The TEAS Plus system streamlines the . Patent and Trademark Office (USPTO) review process and has a lower filing fee of $775, but requires additional LegalZoom labor to process. If we are able to use the TEAS Plus system for your application, LegalZoom will still charge $775, of which $775 will be allocated to the USPTO fee and $55 to a LegalZoom processing fee. The USPTO may later charge a $675 fee should you choose not to communicate with them electronically or otherwise meet the requirements of the discounted Teas Standard or TEAS Plus filing fees.

I would warn people that even if it is just a slight bit complicated, don't expect too much from LegalZoom. But overall, I'm still better off having worked with LegalZoom on the other two cases. I just wished LegalZoom would have said, “Sorry, can't help you,” or, ”Wow, this is getting a little bit more complicated” on that one case. But there was no human interface there too. So I understood. I understand that it isn’t perfect and that there are limitations.

I ordered a business license and EIN number from Legal Zoom 8 months ago!! Still haven't received anything.. I tried calling to get help, it takes hours to get someone on the phone.. And they always say, "We have to call you back".. I never receive any calls.. Now I'm unable to receive a refund.. Please don't use this company! PLEASE!!

As fate would have it, James unknowingly made a mistake while completing the trademark application.  The brand name he listed on the application was hyphenated, whereas the name shown on the product packaging sample he submitted with his application was not.  Also, the brand name shown on the application was in quotation marks, whereas the product packaging displayed the trademark without quotation marks.  Several months after submitting his application, James received an office action from the USPTO.  The examining attorney preliminarily refused registration of James’ mark because of the relatively minor differences between the trademark shown in the application and the trademark printed on the product packaging.

The USPTO trademark forms are complicated. I figured it out, I think, and submitted our response. Hopefully we will have an answer soon. I feel like Legal Zoom falsely advertises and is doing a bait and switch. My meaning. We'll submit the paperwork for you but if you want an attorney you will have to pay more. A typical bait and switch. Not happy. When an application is filed in the name of the wrong applicant , the mistake cannot be cured by simply amending the application or assigning it to the proper party.  The application is void and any resulting registration has no legal effect.  It’s too bad Michael had to learn the hard way.
